1. Acceptance of Terms

By accessing or using posthell ("Service", "we", "our"), you agree to be bound by these Terms of Service ("Terms"). posthell is operated by Rohan Gotwal as a sole proprietor. If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all users of the Service.

2. Description of Service

posthell is a social media post scheduling service. It lets you connect your social accounts, write a post once, tailor it per network, schedule it, and have it published automatically. The Service includes:

  • Connecting multiple social networks through our publishing partner (Zernio)
  • A composer with per-network text variations and media uploads
  • Scheduling, drafts, and a posting calendar and queue
  • Automatic publishing with retries, and post analytics

Publishing to your connected networks is carried out by Zernio on our behalf. We do not control the social networks themselves and cannot guarantee that a given network will accept or deliver any post.

3. Account Registration and Eligibility

3.1 Eligibility

You must:

  • Be at least 18 years old (or the age of majority in your jurisdiction)
  • Have the legal capacity to enter into binding agreements
  • Provide accurate and complete information
  • Maintain the security of your account credentials

3.2 Account Responsibility

You are responsible for:

  • All activity that occurs under your account, including everything you publish
  • Maintaining the confidentiality of your account credentials
  • Notifying us immediately of unauthorized access
  • Ensuring your account information remains current

4. Acceptable Use

4.1 Permitted Use

You may use the Service to:

  • Schedule and publish content to social accounts you own or are authorized to manage
  • Manage your own social media presence for legitimate purposes

4.2 Prohibited Activities

You agree NOT to:

  • Use the Service for illegal purposes or in violation of any laws
  • Connect or publish to accounts you do not own or are not authorized to manage
  • Publish content that is unlawful, infringing, deceptive, harassing, or hateful
  • Send spam or engage in coordinated inauthentic or automated posting
  • Violate the terms or policies of any connected social network
  • Attempt to reverse engineer, decompile, or hack the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Exceed reasonable usage limits or attempt to circumvent post credits
  • Resell or redistribute the Service without authorization
  • Infringe the intellectual property or other rights of any third party

5. Third-Party Social Networks

When you connect a social network, your use of that network remains subject to its own terms and policies. You are responsible for complying with them.

  • A network may rate-limit, suspend, disconnect, or terminate your account for policy violations. Where we receive such a signal, we will surface it to you, but we are not responsible for a network's decisions.
  • Account connections and publishing are brokered through Zernio; your use of that integration is also subject to Zernio's terms.
  • We are not liable for content moderation, feature changes, outages, or pricing changes imposed by the social networks.

6. Subscription Plans and Billing

6.1 Plans

We offer subscription plans (currently Solo and Pro) with different connected-account limits and monthly X post credits. Current plan details and prices are shown on our pricing page and may be updated from time to time.

6.2 No Free Trial

posthell is a paid service with no free trial. A paid plan is required to connect accounts and schedule posts. You can cancel at any time, and your subscription stays active until the end of the current billing period.

6.3 Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • Payment is processed through DodoPayments
  • Prices are in USD unless otherwise stated
  • All fees are non-refundable except as required by law
  • Failed payments may result in service suspension

6.4 Cancellation

You may cancel your subscription at any time from Settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

6.5 X Post Credits and Usage Limits

Publishing to X (formerly Twitter) is metered with post credits, because it carries a per-request cost. All other connected networks are unlimited on every plan.

  • A plain X post uses 1 credit; an X post that contains a link uses 13 credits, reflecting the higher cost charged to us.
  • Your plan includes a monthly credit allotment that resets at the start of each billing period. Credits do not roll over.
  • If you run out of credits, posting to X is paused until your next billing period or until you upgrade. Other networks remain available.
  • If a post fails to publish, any X credits it used are refunded automatically.

7. Your Content

7.1 Ownership

You retain ownership of the content you create and publish through the Service. You grant us a limited, non-exclusive license to store, process, and transmit that content solely to operate the Service and publish it to the networks you select.

7.2 Responsibility for Content

You are solely responsible for the content you publish and for ensuring you have the rights to publish it. We do not pre-screen content and are not responsible for content you choose to schedule or publish.

7.3 Account Deletion

Upon account deletion, your associated data will be permanently deleted within 30 days, and we will ask our publishing partner to revoke any connected-account access. This action cannot be undone.

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by posthell and protected by applicable copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your legitimate purposes in accordance with these Terms.

9. Service Availability and Modifications

We strive to maintain high availability and to publish scheduled posts on time, but because publishing depends on third-party networks and our publishing partner, we do not guarantee:

  • Uninterrupted or error-free service
  • That every post will be accepted or delivered by a given network
  • Availability of all features at all times

We reserve the right to modify, suspend, or discontinue features, perform maintenance, and update the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
  • We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
  • We are not liable for any indirect, incidental, special, or consequential damages
  • We are not liable for posts that fail to publish, are delayed, or are removed by a social network
  • Our total liability is limited to the amount you paid in the 12 months preceding the claim
  • We are not responsible for loss of data, profits, or business opportunities

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless posthell and its operator from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • The content you publish through the Service
  • Your violation of these Terms
  • Your violation of any third-party rights or any social network's policies
  • Your violation of any applicable laws or regulations

12. Termination

We may terminate or suspend your account immediately, without prior notice, if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activities
  • Fail to pay subscription fees
  • Abuse the Service or attempt to circumvent its limits

Upon termination, your right to use the Service ceases immediately, and we may delete your data according to our data retention policies.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or prominent notice on our website. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

If you do not agree with the modified Terms, you must stop using the Service and may terminate your account.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict of law provisions. The courts located in India shall have jurisdiction over any disputes, subject to the resolution process below.

Any disputes arising from these Terms or the Service shall be resolved through:

  1. Good faith negotiation between the parties
  2. If negotiation fails, binding arbitration conducted in India in accordance with the Arbitration and Conciliation Act, 1996
